Seller Contract


The undersigned consignor has made a donation of baby, children, adult, and/or home items to the First United Methodist Church Nursery School Online Kids Closet Consignment Sale.Items are being sold under consignment by First United Methodist Church Nursery School Kids Closet and a fee of 65% of the sale amount of the consignor’s items sold will be paid to the consignor by check within one week of the sale's end. No participation fee will be charged. A virtual fee of $.25 per item will be automatically added to the purchase price once it is posted in the virtual store. This amount will be collected by Kids Closet to account for fees associated with the virtual sale. If you are signed up to work shifts before, during, or after the sale and are unable to work your scheduled shift, you are responsible for finding someone to cover your shift. If you do not find a substitute to work your shift, the fee paid on your consigned items will reduce from 65% to 50%. Consignor retains the risk of loss and First United Methodist Church Nursery School Kids Closet assumes no liability for any lost, stolen, missing, or damaged items. Kids Closet Sale committee or volunteers will not be held responsible for administrative errors.Due to the nature of the virtual sale, Consignors are responsible for fully inspecting their items and listing the condition of the item accurately. Only good and excellent quality items should be consigned. Pictures should accurately showcase each individual item. Item quality will be inspected at drop off and Kids Closet reserves the right to reject items if not in good condition. Should an item dropped off by the seller be rejected by the Kids Closet due to condition, a $2.00 fee will be assessed to the seller and the item deducted from the seller's Settlement Report. If more than ten items are rejected by Kids Closet due to condition, the seller will relinquish their right to sell at future Kids Closet Sales for a period of 2 years. In addition, shoppers will have the right to inspect the items they purchase and reject an item and be refunded ONLY if the item is defective, damaged, missing, or wrong. When a consignor enters an item into the online sale, the item MUST be available at the conclusion of the sale. Following the conclusion of the sale, items must be labeled with buyer info obtained through My Consignment Manager and dropped off during the chosen drop-off appointment time. If an item entered in the sale is not dropped off, the buyer will be refunded and $10.00 for each missing item or the cost of the missing item (whichever amount is greater) will be deducted from the seller's check. If a seller does not drop off any items sold, they will relinquish their right to sell at future Kids Closet Sales for a period of 2 years. The undersigned has been informed of the date and time for drop off of sold items. Recalled Items: The Consumer Product Safety Improvement Act was signed into law on August 14, 2008, and it became unlawful to resell recalled items. Each individual consignor/reseller is liable for their own items. All consignors should check the CPSC website (www.cpsc.gov) for information on recalled items before reselling an item. Consignors should pay special attention to recalled children's products, particularly cribs and play yards; children's products that may contain lead, such as children's jewelry and painted wooden or metal toys; flimsily made toys that are easily breakable into small parts; toys that lack the required age warnings; and dolls and stuffed toys that have buttons, eyes, noses, or other small parts that are not securely fastened. If an item is consigned with Kids Closet, Kids Closet will rely on the fact that the individual consignor/ reseller has checked their own products against the CPSC list of recalled items and all items are safe to resell. The reselling of recalled items could carry civil and/or criminal penalties. FUMC NS Kids Closet cannot be held accountable if a recalled item is sold or bought, as it is the individual consignor’s duty to directly check their own items they choose to sell, not the duty of Kids Closet.
